Consultant: Legal (Customs & Excise Litigation)
The South African Revenue Service (SARS) is the national authority responsible for collecting taxes and managing customs services. We are looking for a dedicated Legal Consultant to join our team, focusing on Customs and Excise litigation. In this role, you will handle legal research and prepare cases involving both simple and complex tax issues while ensuring all work follows internal governance standards.
Job Purpose
The successful candidate will research and prepare pre-litigation and litigation matters related to customs and excise. You will manage cases ranging from straightforward disputes to complex legal interpretations, ensuring that SARS is well-represented in legal proceedings.
Requirements
To be considered for this position, you must meet one of the following criteria:
- Option 1: A Bachelor’s degree or Advanced Diploma (NQF 7) in Law (LLB preferred), plus 5 to 7 years of experience in Customs and Excise or International Trade Law. At least 2 to 3 years of this experience must be at a technically skilled level.
- Option 2: A Senior Certificate (Matric/NQF 4) plus 10 years of experience in Customs and Excise or International Trade Law. At least 2 to 3 years of this experience must be at a technically skilled level.
Key Responsibilities
Legal and Litigation Management
- Prepare and manage cases for various legal platforms, including Magistrates Courts, Higher Courts, the Supreme Court of Appeal, and the Constitutional Court.
- Lead settlement negotiations with taxpayers and their legal representatives.
- Analyze facts and legal sources to provide sound advice and implement effective courses of action.
- Identify potential risks and trends within the legal landscape to protect the organization’s interests.
Process and Governance
- Recommend improvements for specialist systems and procedures.
- Ensure all work complies with policies, legislation, and ethical standards.
- Prepare detailed reports and progress updates for management decision-making.
- Initiate and support procedural changes to improve operational efficiency.
Stakeholder and Team Collaboration
- Provide expert legal advice to both internal departments and external stakeholders.
- Maintain strong working relationships with colleagues to achieve team goals.
- Promote a culture of service excellence and professional integrity.
